Terms of Service

Apex AI (the “Service”) is built and operated independently by an individual developer based in Ontario, Canada. It is not operated by a corporation, and there is no company behind it. In these Terms, “I”, “me”, and “my” refer to that individual operator, and “you” refers to the person or business using the Service.
By using this website, requesting a demonstration call, or paying for the Service, you agree to these Terms.
1. The Service is not an emergency service
Do not rely on the Service for anything life-safety critical. Apex AI answers telephone calls, collects information, and forwards or records them according to rules you configure. It is not a monitoring service, an alarm service, a medical service, or an emergency dispatcher.
Anyone facing a fire, a gas leak, a medical emergency, or any other immediate danger should call 911 or the relevant utility emergency line directly. Neither you nor your callers should treat a call handled by the Service as a substitute for doing so.
2. What the Service does
When calls reach a telephone number assigned to you, an AI assistant answers, asks about the problem, and collects details such as the service address and a callback number. It then either escalates the call to a phone number you nominate or records the call for you to review, based on the emergency rules you provide during setup.
The Service is delivered using third-party telephone, AI, and infrastructure providers. Its behaviour depends on those providers, on your carrier's call forwarding, and on the rules you write.
The AI is instructed not to quote prices, promise arrival times, or guarantee that any problem can be fixed. It may still make mistakes, mishear a caller, or classify a call differently than you would have.
3. The demonstration call
The demonstration places a single automated call to the number you enter. Request it only for a number you own or are authorised to receive calls on.
The demonstration is provided as-is, for evaluation only, and may be changed, limited, or withdrawn at any time. Demonstration requests are rate limited. Do not rely on it for urgent or safety-critical communication.
4. Fees and billing
- $499 CAD setup and onboarding fee — a one-time charge, due when you sign up. It covers provisioning your line, configuring your emergency rules, and getting your call forwarding working. It is not part of the free trial.
- $249 CAD monthly retainer — begins after a 14-day free trial and recurs monthly until cancelled.
All amounts are in Canadian dollars and are exclusive of any applicable taxes. Payments are processed by Stripe; I do not receive or store your full card details. Prices may change on notice, and any change applies from your next billing period rather than retroactively.
5. Trial, cancellation, and refunds
The 14-day free trial applies to the monthly retainer. Cancel before the trial ends and the retainer is never billed.
After the trial there is no minimum term and no cancellation fee. You may cancel at any time by emailing dante@apexdispatch.app. I will confirm the cancellation and stop billing the retainer.
The setup fee pays for work that is performed by hand shortly after you sign up. If you want to discuss a refund, email me and I will deal with it directly — refund requests are handled case by case rather than by a blanket policy.
Call forwarding is controlled from your own handset. Cancelling the Service does not turn forwarding off — dial your carrier's deactivation code to send calls back to your own phone.
6. Your responsibilities
- The emergency rules you write determine which calls wake you. You are responsible for their accuracy and for keeping them current.
- You are responsible for the telephone numbers you configure, including having the right to forward calls from them and to receive calls on the dispatch number you nominate.
- You are responsible for telling your callers whatever your own legal or professional obligations require about calls being handled by an AI assistant and recorded or transcribed.
- Do not use the Service unlawfully, to harass anyone, or to place unsolicited calls.
7. Availability and no warranty
The Service is provided on an as-is and as-available basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by applicable law. I do not warrant that it will be uninterrupted, error-free, or that any particular call will be answered, classified, or escalated correctly.
The Service depends on telephone networks, carriers, and third-party providers that I do not control. Outages, delays, and misrouted calls are possible.
Nothing in these Terms limits any rights you may have under applicable consumer protection legislation that cannot lawfully be excluded.
8. Limitation of liability
To the fullest extent permitted by applicable law, I am not liable for indirect, incidental, special, or consequential damages, or for lost profits, lost business, or missed work, arising out of your use of the Service.
To the fullest extent permitted by applicable law, my total liability arising out of or relating to the Service is limited to the amount you paid me for the Service in the twelve months before the event giving rise to the claim.
9. Suspension and termination
I may suspend or end the Service where it is being used unlawfully, where payment fails, or where continuing to provide it is no longer practical. Where I end the Service without cause, I will give you reasonable notice so you can turn call forwarding off first.
10. Privacy
Calls handled by the Service may be recorded and transcribed. How personal information is collected, used, disclosed, and retained — including call audio and transcripts — is described in the Privacy Policy, which forms part of these Terms.
11. Changes to these Terms
I may update these Terms as the Service changes. The “Last Updated” date above shows when they were last revised, and material changes affecting existing customers will be sent by email before they take effect.
12. Governing law
These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable there, without regard to conflict of laws rules.
